§ 2-113. General legal services.

  • The attorneys selected by the city administrator through the procurement process and approved by the board of directors pursuant to sections 2-111 and 2-112 shall provide the following general legal services for the city:

    (1)

    Management of all litigation in which the city is a party or in which the city has an interest;

    (2)

    Reserved;

    (3)

    Representation of the city and all city officials or employees in their official capacities and representation of city officials or employees in their individual capacities if the litigation relates to the duties of said officials or employees. Conflicts of interest shall be handled pursuant to Fort Smith Code section 2-114(b). To the extent required by law, any judgment rendered against a city official or employee in their official capacity shall be paid by the city. To the extent permitted by law, any judgment rendered against a city official or employee in their individual capacity may be paid by the city after review and approval by the board of directors of the city;

    (4)

    The providing of legal advice to the city administrator and, through the city administrator, the officers and officials of the city upon any and all legal questions affecting the city's interests;

    (5)

    Providing of legal services with reference to property acquisitions by the city;

    (6)

    The approval as to form of all legislation proposed for consideration by the board of directors;

    (7)

    The approval as to form of all contracts, bonds, insurance policies, and other documents filed with the city or as to which the city is a party; and

    (8)

    The providing of advice and drafting services to members of the board of directors under such circumstances as a majority of the board may request or prescribe.
