§ 7-28. Interment/inurnment procedure.

  • (a)

    When a lot is jointly owned, as specified on the cemetery deed, only the record owner may designate which space is to be used.

    (b)

    No grave spaces shall be sold in the alleyways.

    (c)

    When a burial or inurnment is required, notice at the earliest practicable time shall be given by the funeral director. The cemetery reserves the right to insist on at least twenty-four (24) hours of notice prior to the interment/inurnment time, in order to prepare the grave site or niche.

    (d)

    Except for the reinterments resulting from the city Mill Creek Channelization Project relocation of portions of the Sebastian County Pauper's Cemetery, only one (1) interment may be made in each grave, except when the remains are those of parent and infant or in the case of cremation. In the case of cremation, up to two (2) cremains may be interred in one (1) purchased grave space. All paupers to be interred in Oak Cemetery shall be cremated.

    (e)

    The grave space or niche and opening/closing fee must be paid for before interment/inurnment will be permitted unless satisfactory arrangements have been made with the city administrator or his designated agent.

    (f)

    No more than one (1) upright or flat grave marker may be placed at the head of any grave space and no more than one (1) flat marker may be placed at the foot of any grave space. Whether upright or flat, the length of any single grave markers shall not exceed three (3) feet and the width shall not exceed eighteen (18) inches. Whether upright or flat, the length of any double grave markers shall not exceed six (6) feet and the width shall not exceed eighteen (18) inches. No other grave markers are allowed including benches.

    (g)

    Alley grave markers, for spaces previously sold, may be either flush slabs or headstones no more than one (1) foot high and installed so that access to adjacent sites is not blocked.

    (h)

    A vault or box, except for cremation, made from concrete, steel or fiberglass is required for all burials except with the permission of the city administrator, or his designated agent.

    (i)

    A family member, their designee or legal representative must bring an "Authorization for Cremation and Disposition" form showing all necessary signatures prior to the inurnment.

    (j)

    No disinurnment will take place without the prior written authorization of the niche owner or his or her legal representative.

    (k)

    Any and all disinurnment costs/fees will be borne by the niche owner or his or her legal representative.

    (l)

    No more than two (2) industry standard urns may be placed in a single niche.
