§ 25-279. Landfill regulations.

  • (a)

    It shall be unlawful for any person, either directly or through others, to deliver solid waste for disposal at the city landfill without paying the charges established by ordinance. It shall be unlawful for any person, either directly or through others, to knowingly claim that solid waste which originated outside of the county is waste originating inside the county for the purpose of permitting same to be disposed of at the city landfill or to be disposed of at the lower rates provided for county waste. Any person violating any provision of this section shall be deemed guilty of a misdemeanor and, upon conviction, shall be subject to the penalties set forth in section 1-9. In addition to the penalties imposed by section 1-9, any person violating this section shall be prohibited from disposing of solid waste at the landfill.

    (b)

    No yard waste other than separated yard waste will be accepted at the city's landfill.

    (c)

    Liquid waste and tires originating from sources outside the county are prohibited in the city's landfill.

    (d)

    All motor vehicles hauling garbage, trash or other waste to the city landfill shall be appropriately covered or enclosed so as to prevent any portion of the vehicle's contents from leaking, blowing, dropping, falling off or otherwise departing from the vehicle; provided any motor vehicle, the contents of which are predominantly metallic materials or brush and limbs, shall not be required to be covered or enclosed in the event that the cargo is loaded and secured in such a manner as to prevent any portion of the cargo from falling or dropping from the vehicle. Any vehicle transporting garbage, trash or other waste and not appropriately covered or enclosed shall be allowed access to the landfill only by paying two (2) times the normal landfill fee for the disposal of the contents of the vehicle. On any free access day for users of the landfill, any vehicle not covered or enclosed as provided herein may be unloaded only after payment of the normal landfill fee for disposal of the contents of the vehicle.

    (e)

    The Fort Smith Landfill accepts waste only from the following counties: Sebastian, Crawford, Franklin, Logan and Scott counties in Arkansas, and LeFlore and Sequoyah counties in Oklahoma.
