Residential and commercial properties which are located within three hundred (300)
feet of an available sewer line but which have not actually been connected thereto,
although it is possible to do so without crossing the real property of any private
owner, shall pay a monthly sewer availability charge equal to seventy-five (75) percent
of the rate which such properties would have paid had they been connected to such
available sewer line. The sewer availability charge shall be computed and collected
as are the monthly rates for properties actually connected to the system.
(b)
All billed and paid sewer availability charges (for a property as to which the city
or account holder has maintained accurate records) shall be credited against the sewer
system tie-on fee and connection charge for such property at the request of the account
holder and at the time of connection to the sewer system. If the paid sewer availability
charges exceed the tie-on fee and connection charge, the difference shall be refunded
to the account holder. The provisions of this subsection (b) shall be applicable to
applications for connection to the system made after January 1, 1994. The credit and
refund provided for is a personal right of the person making the payments and is not
assignable without written authorization from the city administrator.
