§ 22-176. Sidewalk construction program established.

  • (a)

    The program shall provide for construction of sidewalks along residential, arterial or collector streets, construction of sidewalks in conjunction with nonresidential development and construction of sidewalk repairs. The fund balance as of January first of each calendar year shall be used as the primary basis for the construction fund budget for that year.

    (b)

    The engineering department of the city is hereby directed and authorized to prepare a recommended program of sidewalk construction for each calendar year utilizing criteria approved by the board of directors. Such recommended program shall be submitted to the board of directors by October 1 of each year. On or before the first day of November of each calendar year, the board of directors shall adopt a sidewalk construction program which shall, subject to any contingency desired to be maintained in the fund by the board of directors, anticipate the expenditure of the current balance of the fund plus reasonably estimated revenues for the remainder of that year for the construction of sidewalks in a construction program, which shall be scheduled to be completed by September 15 th of the succeeding calendar year.
