When used herein, the term "new street construction" shall have that meaning provided
for in section 22-131 of the Fort Smith Code of Ordinances. Additionally, the term "new street construction"
shall include street or street segments, of the type otherwise identified in section 22-131, where a significant portion (more than fifty (50) percent of linear dimension) of
the right-of-way for the new street construction did not, prior to construction, contain
street facilities although limited portions of the right-of-way may have contained
street facilities which were improved during the project of street construction.
