§ 20-2. Same—Disposition of unclaimed.

  • (a)

    If stolen property shall not be claimed by the owner within six (6) months from the time any person may have been convicted for stealing the same, or if stolen property may have been held in the possession of the chief of police for a period of six (6) months' time without the same being claimed by the owner thereof, the court, or magistrate, or chief of police may order the same to be sold after first having advertised the date and hour of sale for ten (10) days, giving a correct description of said property to be sold in some newspaper of bona fide circulation in the city, or by posting five (5) notices in five (5) conspicuous places bearing the date fixed for the sale and giving a correct description of such property to be so sold. The proceeds of the sale, after the payment of the expenses of the preservation and sale of such property shall be paid into the city treasury for the use and benefit of the city.

    (b)

    In all cases of sale a particular description of the property shall be made out in writing and filed with the court or magistrate or chief of police making the order of sale so that the owner may be enabled to identify the same if he shall claim the proceeds of such sale within the time above fixed for the making of his claim.
