§ 16-17. Repeated failure to maintain property.

  • It shall be unlawful for any owner or occupant of land repeatedly to allow the land owned or occupied by the person to be in violation of the minimum standards established by sections 16-4, 16-5, and 16-16 of this Municipal Code to the extent that an order or notice of abatement is issued by the city three (3) times in any calendar year. For the purposes of this section, any order or notice of abatement issued by the city which is subsequently determined by the city or by judicial authority to not be validly issued shall not be considered as an instance of order or notice for the purposes of the first sentence of this section. In addition to all other penalties and consequences from the issuance of the third or any subsequent order or notice of abatement pursuant to the provisions of this article in the same calendar year, the owner or occupant to whom such notice is issued shall be deemed guilty of a misdemeanor and shall be subject to the penalties set forth in section 1-9 of this Municipal Code.
