§ 16-1. Order to abate authorized—Generally.

  • After inspection and determination as is set out in section 16-6, the city administrator, or his designated representative, is authorized to order, in the name and by the authority of the city, any owner or occupant, or both, of any real property, subdivided or otherwise, within the limits of the city (1) to cut weeds, grass or dead or dying trees, remove garbage, rubbish and other unsightly and unsanitary articles and things, abate all fire and flooding hazards, and to eliminate, fill up or remove stagnant pools of water or any other unsanitary thing, place or condition which might become a breeding place for mosquitoes, flies and germs when any one (1) or more of the above-listed conditions are found to exist on the property or on alleys, utility easements, rights-of-way and/or easements adjoining the property; or (2) repair any building or structure which is determined to be unsightly, unsanitary, obnoxious or which constitutes a fire hazard or in other manner is detrimental to the public welfare.
