§ 15-5. Same—Cost of incarcerating city prisoners.

  • (a)

    In addition to all fines now or as may hereafter be provided by law, there shall be levied and collected in the Fort Smith District Court from each defendant upon each conviction, each plea of guilty, or nolo contendere, or each bond forfeiture, in all cases (except those cases involving the offense of no seatbelt, of failure to carry proof of insurance, parking violations other than parking in handicap zone, and of contempt of court) in the first class of accounting records as described in A.C.A. § 16-17-707, the sum of twenty dollars ($20.00).

    (b)

    All sums collected from this additional fine shall be paid into the city treasury to be deposited into a fund to be used exclusively to help defray the cost of incarcerating city prisoners, including the construction and maintenance of the jail used to incarcerate same, and to help defray the cost of payments to other entities for incarcerating city prisoners.
