§ 14-26. Use of traps or snares restricted; exceptions; penalties.

  • (a)

    Restriction; exception. It shall be unlawful for any person to employ or set any trap or snare designed to catch or kill any animal within the city, except with the written permission of the chief of police finding that one (1) or more of the conditions set forth in subsection (b) exists and adversely affects the public welfare.

    (b)

    Conditions for exception. Nothing contained in this section shall prohibit any person or institution from taking reasonable measures to protect himself and others from a diseased animal or an animal determined to be dangerous, nor from taking such measures as may be necessary to protect his own property (including his house, pets or growing crops) from imminent danger or from animals constituting a nuisance with respect thereto.

    (c)

    Penalties. Any person violating the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction shall be subject to the penalties set forth in section 1-9 of this Code.
