§ 10-38. Penalties.

  • (a)

    Any person who shall violate any of the provisions of the fire prevention code adopted by this article, or who shall fail to comply with any such code or provision, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder or any certificate or permit issued thereunder shall severally for each and every such violation and noncompliance respectively be guilty of a misdemeanor, punishable as set forth in section 1-9 of this Code. The imposition of one (1) penalty for any violation shall not excuse the violation or permit it to continue. Each ten (10) days that prohibited conditions are maintained shall constitute a separate offense.

    (b)

    The penalties established above shall be cumulative with the penalty established by A.C.A. § 12-13-110. The imposition of any penalty for the violation of the provisions of this article shall not be held to prevent the exercise of the authority of the fire prevention bureau to enforce the provisions of the code adopted by this article by orders issued to the owners and/or occupants of any premises to which the code is applicable.
