 FORT SMITH MUNICIPAL CODE

  ORDINANCE NO. 36-09 - AN ORDINANCE ADOPTING THE 2009 UNIFIED DEVELOPMENT ORDINANCE OF THE CITY OF FORT SMITH

    WHEREAS, the Comprehensive Plan of the City of Fort Smith suggests many ways to help guide the growth and development of the city and suggests revisions to the zoning and subdivision regulations as being necessary to implement the goals of the Comprehensive Plan; and,

     

    WHEREAS, the Planning Commission of the City of Fort Smith has spent considerable time reviewing the 2009 Unified Development Ordinance, held twenty-five (25) public meetings and conducted four (4) public hearings to obtain public input; and,

     

    WHEREAS, three (3) copies of the 2009 Unified Development Ordinance of the City of Fort Smith are now on file in the Office of the Clerk of the City of Fort Smith for inspection and review by the public prior to the passage of this Ordinance; and,

     

    WHEREAS, notice has been published in a newspaper of general circulation within the City of Fort Smith giving notice to the public that copies of the proposed 2009 Unified Development Ordinance are available and open to public inspection prior to consideration for passage of this Ordinance, which notice was published on the 10 th day of May, 2009.

     

    NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE BOARD OF DIRECTORS OF THE CITY OF FORT SMITH, THAT:

    Section 1: The 2009 Unified Development Ordinance of the City of Fort Smith, three copies of which have been on file in the office of the City Clerk for inspection and view by the public prior to the passage of this Ordinance, is hereby adopted to become effective on August 12, 2009.

     

    Section 2: As of the effective date, the 2009 Unified Development Ordinance shall supercede and replace the current provisions of chapters 23 and 27 of the Fort Smith Municipal Code, subject to the transitional provisions of Section 27-110 of the 2009 Unified Development Ordinance. The codifier of the Fort Smith Code shall delete the provision of Chapter 23 and hold the chapter in reserve for future use and shall replace the provisions of Chapter 27 with the provisions of the 2009 Unified Development Ordinance codified in such articles, divisions and sections as determined in the discretion of the codifier.
